WHEN A REFERRAL MAY FIT

When a Referral May Fit

A situation may be appropriate for LandHat when:

  • The family does not want to complete all of the probate or title work
  • The estate lacks funds to address the property
  • The property cannot be listed or closed in its current condition
  • One owner wants to sell while others do not
  • Missing or unresponsive owners are delaying action
  • A title company has identified unresolved requirements
  • Taxes, liens, occupants, or property condition are preventing a sale
  • A conventional buyer has withdrawn
  • The owner values certainty and relief more than maximizing the possible future price
  • The property or ownership interest requires more time, coordination, or risk than a typical buyer will accept

LandHat’s Role

LandHat is the buyer.

LandHat does not replace the attorney, title company, fiduciary, agent, or other professional already involved.

Each participant has a different role:

Attorneys

advise clients, determine legal rights, prepare legal documents, and handle court proceedings.

Title companies

identify title requirements, coordinate closing, and determine what they are willing to insure.

Fiduciaries and personal representatives

act within the authority granted by the estate or court.

Real estate agents

represent their clients and market properties that are ready for a conventional sale.

LandHat

provides the proposed purchase, funding, coordination, patience, and willingness to accept agreed transaction risk.

Existing professional relationships are respected.

What Happens After a Referral?

1. Initial Review

Matt reviews the basic property and ownership information. Helpful information may include the property address or parcel number, current deed, owner or estate information, probate status, title commitment or title requirements, tax and lien information, occupancy, property condition, and the issue preventing closing.

Complete information is not required for an initial conversation.

2. Identify the Important Questions

LandHat determines what additional records or facts are needed to evaluate the opportunity.

This may involve deeds, probate filings, tax records, lien information, title requirements, access documents, or communication with the professionals already involved.

3. Determine Whether a Purchase May Be Possible

After reviewing the situation, Matt may make an offer, request additional information, explain what must occur before an offer can be made, or determine that the property does not currently fit.

Matt will provide a direct answer rather than leaving the referral in limbo.

4. Coordinate With the Existing Team

When appropriate, LandHat works with the owner’s attorney, title company, fiduciary, agent, or other professionals to define responsibilities and move the transaction forward.

The written agreement should clearly state what LandHat is buying, what the seller will receive, what conditions must be met, what LandHat will handle, and what remains the responsibility of the owner or existing professionals.

Different professionals encounter different versions of the same stuck property.

Referrals From Real Estate Agents

Some properties are not ready to be listed or cannot close after a buyer has been found.

LandHat may be appropriate when ownership is unclear, probate is unfinished, required signatures cannot be obtained, the property has severe condition or occupancy problems, a title company has stopped the closing, or the owners no longer want to complete the work required for a conventional sale.

LandHat will not represent the seller or interfere with an existing agency relationship.

Any compensation or continuing role for an agent must be clearly disclosed, legally permitted, and agreed upon by the appropriate parties.

Referrals From Attorneys and Title Professionals

LandHat may provide a practical transaction when the legal or title solution exists but the owner does not want to fund, manage, or wait through the entire process.

A purchase agreement may provide a defined reason to complete selected probate, title, lien, or closing work.

LandHat does not direct the attorney’s legal judgment or the title company’s underwriting decision.

Referrals From Other Investors

LandHat may review opportunities that involve partial interests, unfinished probate, missing heirs, failed closings, tax-sale title, old liens or mortgages, occupants, access problems, or difficult coordination among owners.

A direct explanation of the situation, available documents, and reason the opportunity does not fit the referring investor is usually enough to begin.
